The court asked whether an additional tax of one per cent could be levied on diesel-petrol mixed with ethanol. The Jabal Bench of the High Court, headed by Chief Justice Mohammad Rafique and Justice Vijaykumar Shukla, had issued notice on the application during the hearing of the public interest litigation.

In fact the rising prices of diesel and petrol were challenged in the Jabalpur High Court. In a public interest litigation, Manish Sharma, convener of Citizen Consumer Forum Jabalpur, has argued that the government had made it a rule to levy percentage tax on ethanol blended diesel-petrol. It is being taxed at 51 per cent. The matter was heard in a double bench of Chief Justice and Vijaykumar Shukla.
